O Contrato no Direito Comparado (DIN5912)

Objetivos:
Objetivo geral: aplicar a perspectiva teórica e a técnica do Direito Comparado aos contratos, com ênfase na análise das características e relações de similitude e diferença entre o sistema continental europeu e o anglo-americano.
Objetivos específicos:
a. Apresentar os aspectos gerais do Direito Comparado como pressuposto para o desenvolvimento da comporação dos regimes dos contratos;
b. Discutir questões próprias do Direito Comparado, como as difrenças entre culturas jurídicas, as dificuldades de harmonização e os desafios da comparação com a perda do referencial jusnaturalista;
c. Compreender as distinções e proximidades do Direito Comparado com o Direito Internacional Privado e o Direito Privado interno;
d. Apresentar e discutir detalhadamente aspectos técnico-jurídicos dos contratos, com ênfase no common law e civil law;
e. Discutir os desafios da harmonização e da prática da estruturação de contratos em face das diferenças e semelhanças.
