Direito, Moeda e Sociedade (DFD5910)

Objetivos:
Inserida na linha de pesquisa do DFD denominada “Direito e Economia na sociedade globalizada”, a presente disciplina tem o objetivo de proporcionar ao estudante de mestrado e de doutorado discutir, em nível avançado, a relação entre o direito e a moeda enquanto instituição social, bem como as teorias, políticas e instituições relativas à autoridade monetária e à gestão macroeconômica da vida social, com enfoque interdisciplinar. Não se trata, portanto, de um curso sobre os aspectos técnico-jurídicos da moeda e do sistema financeiro, mas sobre sua dimensão política, econômica e social, no contexto da agenda mais ampla de preocupações comuns da Sociologia Jurídica e da Sociologia Econômica. A dimensão internacional dos problemas tratados no curso estará sempre presente ao longo de seu desenvolvimento, sem que se deixem de enfatizar, todavia, importantes peculiaridades do Brasil, como os planos heterodoxos de combate à hiperinflação e seus desdobramentos, bem como as recentes experiências do regime de metas de inflação do Brasil pós-Real e do Brasil pós-crise econômica internacional. Em sua dimensão teórica, o curso pretende explorar o papel do direito em meio à tensão entre, de um lado, o viés tecnocrático da gestão da política monetária e, de outro, sua legitimação democrática.
